They will also determine penalties for non-compliance, and this will be monitored by the EU Commission - There will be no burden on small firms, as small importers (e.g. for dentistry) will not be obliged to comply with a due diligence scheme - Recycled metals, existing EU stocks and by-products are excluded from the regulation - The deal requires the EU Commission to review and report to Parliament and the Council on the effectiveness of the new law. Should it not generate positive results, they are obliged to consider additional mandatory measures. The legislation itself still needs technical work before it is finalized and a vote by the European Parliament could take place before the end of this year, followed by a formal adoption by the EU Council before it would become law. The regulation applies to all conflict-affected and high risk areas in the world. The Commission will draw up a sample list of areas, such as the Democratic Republic of the Congo and the Great Lakes, but companies sourcing from areas that are not on the list will still be responsible for doing due diligence checks on sources.
