Notably, Norway will continue to cover large industrial equipment and incandescent bulbs. The draft text also includes an exemption for EEE weighing less than 1 gram, which brings into scope some components that would be exempt under the Directive on account of being designed and installed in another product and only fulfilling its function as part of another product. The consultation paper indicates that this exemption is expected to cover RFID (radio frequency identification) tags. Other deviations from the Directive include the addition of a definition of "EEE for professional use" and expanded duties for major retailers of EEE. There are new requirements for online or distance sellers, including free like-for-like returns and the need to appoint a representative in European Economic Area countries in which sales are made. Both retailers and municipalities have obligations to protect WEEE, and particularly that containing sensitive data, from theft. Recycling companies also have additional requirements under the proposed regulation, as well as changes to the certification scheme. A new annex to the regulation would clarify how producers' collection obligations should be calculated.
