On Monday, US President Obama unveiled the final version of the Clean Power Plan, marking the first time the US has placed a limit on CO2 emissions from existing power plants. Obama's revised plan incorporates a 32% reduction in emissions by 2030. A mere two days later, in a letter addressed to the US Environmental Protection Agency, 16 of the US states called upon the government to temporarily suspend the Clean Power Plan to allow them challenge its legality in court. Leading the charge is West Virginia Attorney General Patrick Morrisey who believes that states should not be required to start preparing to implement a rule that may eventually get thrown out by the courts. At the same time, a Senate panel has also instigated moves to block the Plan. The Senate Environment and Public Works Committee published a bill on Wednesday attempting to block the Obama administration from implementing the new rules. The bill is now in front of the whole Senate where it will undoubtedly be the subject of further argument and debate. Whether the Plan is able to withstand judicial review remains to be seen.
