Maine Adopts Rule Designating Flame Retardant Chemicals as Priority Chemicals

A rule defining two flame retardant chemicals of high concern as 'Priority Chemicals' was adopted recently by Maine. The rule, which is an amendment to Chapter 889, entails reporting for specific children's products containing deliberately added amounts of DecaBDE and HBCD. These are both used in the additive, non-polymeric form.

The rule, which applies to manufacturers of children's products,  aims to gather information which would help clarify the prevalence of uses in flame retardants in electronic devices, household upholstered furnishings and food & beverage packaging for children of 2 years and younger.

The term "electronic device", as defined by the rule, refers to consumer products  intended for use by children under 12 displaying visual information including, but not limited to:

• Cell phones
• Televisions
• Computer monitors
• Hand-held electronic devices

The deadline for reporting began on March 4th, 2017 and lasts for 180 days.
