EU: Ecodesign Requirements for Off Mode, Standby Mode, and Networked Standby Energy Consumption of Electrical and Electronic Household and Office Equipment, Draft Regulation, January 2022 The year started with the European Commission publishing a draft regulation proposing to repeal the EU Standby Regulation (EC) No. 1275/2008 and setting revised ecodesign requirements for off mode, standby mode and networked standby energy consumption of household and office equipment.  The draft regulation expands the product scope and includes: - Audio speakers - Media streaming devices - Adjustable furniture  - Hair treatment appliances  The ecodesign requirements are set out in Annex II and the conformity assessment procedure continues to be the internal design control set out in Annex IV of the Ecodesign Framework Directive 2009/125/EC or the management system set out in Annex V.  Deadline for comments is 4 February 2022 and can be submitted [here](https://ec.europa.eu/info/law/better-regulation/have-your-say/initiatives/1558-Review-of-ecodesign-requirements-for-standby-and-off-mode-electric-power-consumption/addFeedback_en?p_id=27637593).  2\. **Brazil: Approving Technical Regulation for Low Voltage Electrical Devices, Portaria No. 497, 2021** On 3 January 2022, Portaria No. 497 entered into force approving Brazil’s new technical regulation on low voltage electrical products and repealing INMETRO Portaria 335/2011. The technical regulation annexed to the Ordinance applies to electrical devices used in electrical installations of voltage up to 1 kV with nominal current up to 63A. Detailed marking and instruction requirements are set out in Article 4 and includes a table setting out the mandatory information depending on the product type. Additionally, Article 3 also sets out conditions for the use of ferrous alloys in such products.   3\. Italy: Postponement of Packaging Labeling Obligations, Decree-Law No. 228/2021 On 31 December 2021, the Italian Government published Decree-Law No. 228/2021 (the so-called “Milleproroghe” Decree) which establishes the postponement of the environmental labeling of packaging until 30 June 2022. Article 11 of the Decree-Law has in fact amended Article 15(6) of Law No. 21/2021 and establishes that the obligations set out in Article 219(5) of Legislative Decree No. 152/2006 to label packaging in line with the applicable UNI standards and the obligation to identify the packaging materials in accordance with Decision 97/129/EC will both apply starting from 30 June 2022 (instead of 1 January 2022 as previously established by Law No. 21/2021).  Also, products that do not meet the labeling requirements and have already been sold or labeled on 1 July 2022 (instead of the original deadline of 1 January 2022) may be sold until stocks last. The Decree-Law provides that the Ministry of Ecological Transition shall enact, within 30 days of the entry into force of the labeling obligations, technical guidelines for the correct labeling of packaging.   4\. France: Adaptation of Various Provisions on Extended Producer Responsibility, Decree No. 2021-1904 This Decree, issued by the Ministry of Ecological Transition on 30 December 2021, amends the provisions of the Environment Code to reflect certain changes introduced to the regime of Extended Producer Responsibility by Law No. 2021-1104 of 22 August 2021 on Combating Climate Change and Strengthening Resilience to its Effects. The Decree, initially introduced for public consultation on 21 September 2021, makes the following adjustments: - Introduces a new article R. 541-179 to the Environment Code to complete the transposition of Directive (EU) 2018/851 amending directive 2008/98/EC on waste by specifying that eco-organizations and individual systems shall continue to ensure the prevention and management of waste from products covered by their approvals even if the objectives set for them have been achieved; - Amends Article R. 541-147 of the Environment Code to reduce the minimum rate of financial resources that shall be allocated by eco-organizations and producers' individual systems to the financing of repair to 10% of the estimated costs of repair, instead of 20%. Unlike the original draft, the final Decree maintains the obligation of eco-organizations and individual systems to set up a fund relating to the financing of repair of toys, in accordance with Article R541-146 of the Environment Code. The Decree would also adjust the provisions of the Code relating to the financing of repair under the Extended Producer Responsibility channel to refocus the beneficiaries of this funding to the actors indicated by Law of 22 August 2021, and more specifically its Article 31. The Decree came into force on 1 January 2022.   5\. Russian Federation: Approving the Single List of Products Subject to Mandatory Certification and the List of Products Subject to Declaration of Conformity, Resolution No. 2425, 2021 On 23 December 2021, the Russian Federation Government issued Order No. 2425 approving the new list of products subject to mandatory certification and to declaration of conformity. The Resolution establishes that: - Certificates of conformity and declarations of conformity for products included in the unified list of products subject to mandatory certification and the unified list of products the confirmation of compliance of which is carried out in the form of a declaration of conformity, approved by Decree No. 982/2009 issued before the date of entry into force of this Resolution will be considered valid until the end of their shelf or service life, but no later than 1 September 2025; - Certificates or declarations of conformity for the products specified above will no longer be accepted after the entry into force of this Resolution, i.e. 30 December 2021; - Until 1 September 2025, the production and release in the Russian Federation of the products specified above, complying with the mandatory requirements of national standards the conformity of which is confirmed by valid certificates of conformity or declarations of conformity, is permitted; - Until 1 September 2023, the production and release in the Russian Federation of products without mandatory conformity documentation and without the applicable mark that were not subject to mandatory confirmation of conformity until the date of entry into force of this Resolution is permitted. This Order will enter into force on 1 September 2022, subject to the clauses identified below, and will be valid until 1 September 2028: - Clauses 2, 4, 5 and 6 of this Resolution, which come into force from the date of official publication (i.e. 30 December 2021); - Clauses 5.2 - 5.4, 5.6 - 5.8, sections 6 and 7, clauses 15.2, 15.21, 15.26, 15.32 - 15.36, 16.2 - 16.7, 16.12, 17.3, 17.5, 17.14, 21.1, 21.2 and sections 22 - 26 of the unified list of products subject to mandatory certification, and sub-clauses 1.1.1 - 1.1.3, clauses 1.2, 1.4, 7.1, 10.6 and 10.7 and sections 65 and 66 of the unified list of products subject to declaration of conformity, which come into force on 1 September 2023.   This information is based on the most viewed regulations on C2P this month.
