The European Commission has disallowed national regulations restricting four phthalates (DEHP, DBP, DIBP, BBP), which were on track to take effect in Denmark in December 2015.
The EU Chemicals Agency (ECHA) is currently in the process of assessing whether there is a basis for an EU-wide ban on the four phthalates and, as a result of the Lapin Judgement, this assessment must be completed before Denmark can create its own national rules. The Danish Environment Minister, Kirsten Brosbøl, stated that she has not given up on the prohibition or regulation of phthalates and, consequently, has asked the Environmental Protection Agency to follow up on whether there is a new basis for Danish phthalate regulations if ECHA's assessment does not lead to common EU rules.
