US EPA issues new rule requiring reporting on health & safety of cadmium in consumer products

The United States (US) Environmental Protection Agency (EPA) has issued a final rule requiring manufacturers (including importers) of cadmium or cadmium compounds, including as part of an article, that have been, or are reasonably likely to be,
incorporated into consumer products, to report certain unpublished health and safety studies to EPA.

The rule applies to consumer products, which are defined to mean any product that is sold or made available to consumers for their use in or around a permanent or temporary household or residence, in or around a school, or in or around recreational areas.

Per the rule, potentially affected entities may include, but are not limited to:

  • chemical manufacturers;
  • establishments engaged metals production;
  • wholesalers of toy and hobby goods;
  • discount department stores; and
  • warehouse clubs and supercenters.

The rule amends 40 CFR 716 to add a new paragraph regarding chemical-specific reporting requirements for cadium and cadmium compounds.

The final rule is effective January 2, 2013.
