The County Executive of Suffolk County has approved Local Law No. 26 of 2017 amending that county’s Toxic Free Toys Act. Changes to the law include the following:

The amended content limits for lead, mercury, antimony, cadmium and arsenic apply only to accessible materials in children’s products.

The limits on cobalt have been deleted from the law; mercury and antimony limits have been raised to ≤ 60 ppm; arsenic limit is reduced to 25 ppm.

Off-site testing, using X-ray fluorescence (XRF) technology, of children’s products selected by random inspection of at least ten retailers per quarter.

Products containing certain heavy metals must comply with any applicable state or federal restrictions. Chemicals in products that are not regulated at the state or federal level must comply with the Suffolk County's limits for antimony, arsenic, cadmium, lead and mercury.
Random testing enforcement was set to begin on December 1, 2017.
